Terms of Service

1. Who we are and who these terms apply to

Wellmatched is a personal matchmaking service operated by Dan Zidell ("Wellmatched," "we," "us," or "our"), based in the Dallas, Texas. These Terms of Service ("Terms") govern your access to and use of the Wellmatched service, including our website, application process, compatibility assessment, and any introductions facilitated by us.

By submitting an application, completing the compatibility assessment, or otherwise engaging with Wellmatched, you ("Member," "you," or "your") agree to be bound by these Terms. If you do not agree, do not submit an application or use our service.

2. Nature of the service

Wellmatched is an introduction service. We facilitate curated, one-on-one introductions between adults who we believe may be compatible based on the information they provide to us. Our role ends at the introduction — we do not accompany members on dates, supervise meetings, or manage relationships.

We exercise our professional judgment in evaluating applicants and curating matches, but we make no representation that any introduction will result in a romantic relationship, engagement, marriage, or any other outcome. Matchmaking is an art, not a guarantee.

3. Member eligibility and conduct

To use the Wellmatched service, you must:

• Be at least 21 years of age
• Be legally single — not married or in a legally recognized partnership
• Provide accurate and truthful information in your application and assessment
• Conduct yourself with honesty, respect, and good faith toward other members

You agree not to misrepresent your identity, relationship status, intentions, or any other material information. Wellmatched reserves the right to remove any member from the service at any time, for any reason, at our sole discretion — including but not limited to dishonesty, disrespectful conduct, or any behavior we deem inconsistent with the values of our service.

4. No guarantee of results

Wellmatched makes no warranties, express or implied, regarding the outcomes of its service. We do not guarantee that you will receive a specific number of introductions, that any introduction will lead to a relationship, or that the service will meet your expectations in any particular way.

By engaging with Wellmatched, you acknowledge and accept that matchmaking involves inherent uncertainty, that compatibility is subjective, and that outcomes depend on factors entirely outside our control — including the choices, personalities, and conduct of other individuals.

5. Member safety and independent responsibility

Wellmatched takes reasonable steps to review applicants before facilitating introductions. However, we cannot verify every representation made by members, conduct formal background checks, or guarantee the safety, character, or conduct of any individual we introduce you to.

You acknowledge that:

• You are meeting another adult of your own free will and at your own discretion
• You are solely responsible for your own safety before, during, and after any introduction or date
• Wellmatched has no control over the actions, behavior, or conduct of any member following an introduction
• You should take reasonable personal safety precautions when meeting someone for the first time

We strongly encourage all members to meet initially in public places, inform a trusted friend or family member of their plans, and trust their instincts at all times.

6. Limitation of liability and waiver of claims

To the fullest extent permitted by applicable law, by submitting your application or participating in the Wellmatched service, you expressly agree to release, waive, and hold harmless Wellmatched and its operator, Dan Zidell, from any and all claims, demands, damages, losses, liabilities, costs, or expenses of any kind arising out of or related to:

• The outcome or lack of outcome of the matchmaking process
• Any introduction facilitated by Wellmatched
• The conduct, actions, statements, or behavior of any other member before, during, or after an introduction
• Any personal injury, emotional distress, property damage, or other harm arising from meeting or interacting with a person introduced through Wellmatched
• Any inaccuracy or misrepresentation made by another member

This waiver applies regardless of the cause of action and whether the claim arises in contract, tort, negligence, or otherwise. You understand that this is a material term of your participation in the service and that Wellmatched would not provide introductions without this waiver in place.

In no event shall Wellmatched's total liability to you for any claims related to this service exceed the total amount you have paid to Wellmatched, if any.

7. Dispute resolution and arbitration

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Wellmatched service shall be resolved exclusively through binding individual arbitration, and not through litigation in any court.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Wellmatched. All arbitration shall take place in Collin County, Texas, and shall be governed by the laws of the State of Texas, without regard to conflict of law principles.

Nothing in this section prevents either party from seeking emergency injunctive or equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.

8. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Texas. Any matters not subject to arbitration shall be resolved exclusively in the state or federal courts located in Collin County, Texas, and you consent to personal jurisdiction in those courts.

9. Confidentiality

Information shared between members in the context of an introduction is intended to remain private. You agree not to publicly share, post, or otherwise disclose personal information about other members you are introduced to, including on social media or review platforms, without their express consent.

10. Modifications to these terms

Wellmatched reserves the right to update these Terms at any time. We will update the date at the top of this page when changes are made. Continued participation in the service after any update constitutes acceptance of the revised Terms.
